Terms of Service

You must be at least 18 years old and old enough to form a binding agreement in your jurisdiction to use Lumi Arts. The Services are not for minors.

By using Lumi Arts, you represent that you meet these requirements and that you are not barred from using the Services under applicable law.

• You are responsible for the accuracy of account information you provide.
• You are responsible for all activity under your account, including use of credits, uploads, prompts, and outputs.
• Keep your login credentials secure and notify us promptly if you believe your account has been compromised.
• We may refuse, suspend, or close accounts that violate these Terms, create risk, or misuse the Services.

Lumi Arts provides AI-powered tools for generating, editing, storing, and managing images, videos, references, prompts, task history, and credits. Available models, settings, formats, duration, resolution, pricing, and generation capabilities may change over time.

AI systems are probabilistic. Outputs may be inaccurate, unexpected, incomplete, offensive, similar to other outputs, or not suitable for your intended purpose. We do not guarantee that any output will be unique, error-free, lawful for every use, or commercially usable.

For these Terms, "User Content" means prompts, negative prompts, uploaded files, references, account materials, feedback, and other content you submit. "Output" means images, videos, or other content generated through the Services.

You retain any rights you have in your User Content. As between you and Lumi Arts, and to the extent permitted by applicable law, you own the Outputs generated for you, subject to these Terms and the rights of third parties.

You grant Lumi Arts a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, transmit, display, modify, and create derivative works from User Content and Outputs as needed to provide, secure, support, improve, and enforce the Services and comply with law.

• You must have all rights, permissions, and lawful bases needed to submit User Content.
• You are solely responsible for how you use, publish, distribute, or monetize Outputs.
• You must not represent AI-generated content as a real event, real person, or authentic record when that would be deceptive or unlawful.

Lumi Arts may support private 18+ adult creative content. Adult support is not permission to create harmful, illegal, abusive, or non-consensual material.

• Do not break the law, infringe rights, or violate these Terms.
• Do not upload malware, scrape the Services, reverse engineer non-public systems, overload infrastructure, or interfere with security.
• Do not use automated systems to create accounts, harvest content, abuse promotions, bypass rate limits, or exploit pricing.
• Do not use the Services to impersonate others, mislead viewers, commit fraud, or create deceptive public content.
• Do not resell, sublicense, or provide hosted access to the Services unless we authorize it in writing.

We may use automated and manual review to detect abuse, review references, investigate reports, protect the Services, enforce these Terms, and comply with law.

We may block prompts, reject uploads, remove content, limit features, suspend accounts, terminate access, withhold or revoke credits, report unlawful conduct, or preserve records when we believe it is appropriate.

Certain features require credits, paid plans, or one-time purchases. Prices, credit costs, model availability, subscription benefits, and plan limits may change over time.

• Credits are reserved or deducted when you submit a generation or use a paid feature.
• If a generation fails for a platform reason, reserved credits are normally returned automatically.
• Subscription credits, promotional credits, and pack credits may have different expiration rules shown at purchase or in the product.
• Payments are processed by third-party payment providers. You authorize us and our payment providers to charge applicable fees, taxes, renewals, and other amounts you choose.
• You are responsible for taxes, duties, currency conversion fees, and payment provider fees unless stated otherwise.

Subscriptions renew automatically unless canceled before the renewal date. You can cancel through account or billing controls where available, or by contacting us.

Cancellation stops future renewals but does not automatically refund prior charges or unused credits. Refunds are handled under our Cancellation and Refund Policy and applicable law.

The Services may include or rely on third-party services, including payment processors, authentication providers, hosting services, storage, analytics, safety tools, and AI model providers. Your use of third-party services may be subject to their own terms and policies.

We are not responsible for third-party services that we do not control.

Lumi Arts, the Services, software, interfaces, design, trademarks, logos, and related technology are owned by Lumi Arts or its licensors and are protected by intellectual property laws.

Except for the limited rights expressly granted in these Terms, no rights are transferred to you. You may not copy, modify, distribute, sell, lease, or create derivative works of the Services except as allowed by law or by written permission.

If you provide ideas, suggestions, bug reports, or feedback, you grant us the right to use them without restriction or compensation.

We may modify, suspend, discontinue, rate limit, or restrict any part of the Services at any time. We do not guarantee uninterrupted availability, specific model uptime, permanent storage, or continued support for any feature.

You may stop using the Services at any time. We may suspend or terminate access if you violate these Terms, create risk, fail to pay, misuse credits, or if we discontinue the Services.

Sections that by their nature should survive termination will survive, including ownership, payment obligations, enforcement, disclaimers, limitation of liability, indemnity, and dispute provisions.

The Services are provided "as is" and "as available" to the maximum extent permitted by law. We disclaim warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and uninterrupted operation.

You use the Services, User Content, and Outputs at your own risk.

To the maximum extent permitted by law, Lumi Arts and its affiliates, service providers, licensors, officers, employees, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, loss of goodwill, or service interruption.

To the maximum extent permitted by law, our aggregate liability for any claim relating to the Services will not exceed the greater of the amount you paid to Lumi Arts for the Services in the three months before the event giving rise to the claim or USD 100.

You agree to defend, indemnify, and hold harmless Lumi Arts and its affiliates, service providers, licensors, officers, employees, and agents from claims, damages, losses, liabilities, costs, and expenses arising from your User Content, Outputs, use of the Services, violation of these Terms, or violation of rights or laws.

These Terms are governed by the laws applicable to the operator of Lumi Arts, except where mandatory consumer protection laws require otherwise.

Before starting a formal dispute, you agree to contact us and try to resolve the issue informally.

We may update these Terms from time to time. The updated version will be posted with a new last updated date. Continued use of the Services after changes become effective means you accept the updated Terms.
